On February 18, 2019, Sim Israeloff and Lishel Bautista recovered a Summary Judgment in favor of our clients, landowners/royalty owners, in a long-running case.
The clients were sued for breach of contract involving oil and gas royalty review services. In 2017, a judgment was entered for the Plaintiff and against our clients for $732,000. Julia Pendery of the firm’s appellate group succeeded in getting the judgment reversed and the case remanded back to the trial court for further proceedings. In a complete reversal of the original judgment, Sim and Lishel argued that the Plaintiff was entitled to no damages from our clients as a matter of law. The court agreed and entered a take-nothing judgment which included an award of taxable costs to our clients.
